Magikly is Coming Soon

Magikly is developing a curated marketplace for spiritual Practitioners and Clients seeking Guidance and commissioned offerings. The marketplace is not yet operating through this website. Current pages, demonstrations, sample storefronts, descriptions, images, prices, features, and launch timing are informational previews and may change.

We do not guarantee a launch date, continued availability, particular features or offerings, acceptance of any Practitioner, or participation by any person. Nothing on the current site creates a marketplace transaction, Practitioner-client relationship, employment relationship, partnership, or agency relationship.

Waitlist

You may provide an email address to request notice about Magikly’s opening and closely related launch updates. Joining the waitlist does not guarantee early access, an account, availability, or any particular service. You are responsible for providing an email address you are authorized to use and for keeping it accurate.

Practitioner applications

Practitioners may submit an application through the third-party form linked or embedded on the site. An application is an expression of interest only. Magikly may review, decline, pause, or discontinue an application at its discretion, subject to applicable law, and is not obligated to provide a reason or complete a review within a particular time.

Submitting an application does not guarantee acceptance, create a commercial agreement, reserve a storefront, or promise future marketplace participation. Any future Practitioner participation will require separate terms or agreements provided before launch.

Your submissions

You retain ownership of information and work samples you submit. You give Magikly permission to access, store, reproduce internally, and review those materials only as reasonably needed to evaluate your application, communicate with you, operate the site, and protect the service. This permission is non-exclusive and ends when the information is no longer reasonably needed, subject to backup, legal, and recordkeeping requirements.

You represent that your submissions are accurate to the best of your knowledge, that you have the rights needed to provide them, and that they do not unlawfully disclose another person’s confidential or personal information. Please anonymize client samples and do not upload material you are not authorized to share.

Acceptable use

You may not:

• use the site unlawfully, fraudulently, or to harm or harass another person;
• interfere with the site’s operation, security, or access controls;
• introduce malicious code, probe for vulnerabilities, or attempt unauthorized access;
• scrape, copy, or use site content at scale except as allowed by law or our written permission;
• impersonate another person or misrepresent your affiliation; or
• submit content that infringes intellectual property, privacy, confidentiality, or other rights.

Magikly content and branding

The site and its content—including Magikly’s name, logos, visual design, text, graphics, software, and curated presentation—are owned by Magikly or used with permission and are protected by applicable intellectual property laws. These Terms do not grant you a license to use Magikly’s trademarks, branding, or content except for ordinary personal access to the site. All rights not expressly granted are reserved.

Third-party services and links

The site relies on or links to third-party services, including the Tally application form. Magikly does not control third-party services, and their own terms and privacy practices apply. Links do not imply endorsement. We are not responsible for third-party content, availability, or practices to the extent permitted by law.

Availability and changes

We may change, suspend, or discontinue any part of the Coming Soon site, waitlist, application, content, or planned features at any time. We do not promise uninterrupted, error-free, or permanently available access. We may restrict access where reasonably necessary for security, maintenance, legal compliance, or misuse prevention.

Disclaimers

To the fullest extent permitted by law, the current site and its content are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Current content is provided for general informational and preview purposes. It is not medical, mental-health, legal, financial, or other professional advice, and it should not be used as a substitute for advice from a qualified professional. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Magikly and the people involved in operating the site will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to the current site, waitlist, application, or third-party services. Magikly’s total liability for claims related to the current free Coming Soon site will not exceed one hundred U.S. dollars (US $100).

These limits do not apply where liability cannot lawfully be limited or excluded. Nothing in these Terms limits rights you may have under applicable consumer law.

Changes to these Terms

We may update these Terms as the site develops or our practices change. Revised Terms will be posted here with a new effective date. Your continued use of the site after revised Terms take effect means you accept them. Separate marketplace terms will be provided before transactional features become available.
